1. Definitions

• Service refers to the creation and delivery of AI-generated artwork based on customer-provided photos or descriptions.
• User means any individual or entity who accesses or uses the Service.
• Content means any images, text, or other materials supplied by the User for the purpose of generating AI art.
• Deliverables means the final AI-generated artwork files provided to the User.

2. Acceptance of Terms

By submitting an order or using the Service, you (“User”) agree to these Terms & Conditions in full. If you do not agree, you must not use the Service.

3. User Responsibilities and Content

• Accuracy & Ownership: You represent and warrant that you own or have all necessary rights to any Content you submit, and that its use will not violate the rights of any third party.
• Prohibited Content: You may not submit Content that is illegal, infringing, defamatory, obscene, or violates any applicable laws or regulations. I reserve the right to refuse or remove any request at our discretion.

4. AI-Generated Artwork

• Creative Process: The AI model analyzes your submitted Content and instructions to generate artwork. The process may involve automated transformations, stylizations, or compositing.
• Quality & Revisions: I will deliver artwork consistent with your instructions. I offer up to three rounds of minor revisions (e.g., color tweaks, change of style). Major redesigns may incur additional fees.

5. Intellectual Property & Licensing

• User Content: You retain all rights in the original Content you supply.
• AI-Generated Deliverables: Upon full payment, I grant you a non-exclusive, worldwide, perpetual license to use the Deliverables in any medium, including commercial usage, subject to these Terms.
• Provider Rights: I retain the right to use anonymized or portfolio-worthy samples of the Deliverables for marketing, display, or educational purposes, unless you expressly opt out in writing.

6. Payment & Refunds

• Fees: All fees are quoted in [$ USD] and are due in full prior to delivery unless otherwise agreed.
• Refund Policy: Because AI-generated art is customized, I do not offer refunds. However, if you are unsatisfied, please contact me—reasonable revisions will be accommodated as noted up to 3 free revisions.

7. Privacy & Data Security

• Data Usage: I will use your Content solely for the purpose of delivering the Service. I will not share your personal information or images with third parties, except as necessary to fulfill your order (e.g., hosting, payment processing).
• Storage & Retention: I retain submitted Content and generated artwork for up to [5] days to facilitate revisions. After this period, I may delete files unless you request extended storage.

8. Disclaimers & Limitation of Liability

• “As-Is” Service: The Service is provided “as-is.” I make no warranties, express or implied, regarding merchantability, fitness for a particular purpose, or non-infringement.
• Liability Cap: To the maximum extent permitted by law, our total liability under these Terms will not exceed the fees you paid for the specific Deliverable. I am not liable for indirect, incidental, or consequential damages.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including attorney’s fees) arising from your Content or your breach of these Terms.

10. Termination

I may suspend or terminate your access to the Service at any time, without notice, if you breach these Terms or engage in unlawful or abusive behavior.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of [California/United States of America]. Any disputes will be resolved in the courts of [City of Los Angeles], unless we both agree to binding arbitration.
